Probate can seem straightforward at first glance – but it often brings hidden delays, legal responsibilities, and emotional weight. Here are three things we often hear from people who wish they’d known earlier.
1. It takes way longer than you think.
Many people assume probate will be done in a few weeks. In reality, it can take several months – even for simple estates. Paperwork must be gathered, assets valued, forms completed, and permissions granted by the Probate Registry. If HMRC is involved or there’s property to sell, it can stretch on much longer. Knowing this upfront helps manage expectations.
2. The values really matter – and HMRC checks them.
Estimating the value of property or belongings may seem harmless, but inaccurate figures can cause real problems. HMRC can challenge under- or over-valuations, and mistakes can delay the process or even result in penalties. A formal property valuation is often the safest route – especially if the estate might owe inheritance tax.
3. Being the executor means personal responsibility.
If you’re the executor, you’re legally responsible for making sure everything is done correctly. That includes paying debts, valuing the estate, filing paperwork, and distributing assets. If something goes wrong, you could be held personally liable – even if you were just trying to help.
